Claims (Counterclaims – Incidental Claims – Fees – Collection – Legal Effects)
The failure to collect the prescribed fees for counterclaims or amended claims falls within the responsibility of the court registry and does not result in the invalidity of such claims or prevent the court from hearing and adjudicating them.
This is based on the established principle that a financial irregularity in the performance of a procedural act does not render the act void, unless the law explicitly provides for nullity as a consequence of such irregularity.
