(Extension – Court – Rent – Increase)
The court has no authority to compel the landlord to extend the lease contract without a corresponding increase in the rent. Likewise, the tenant cannot be obligated to accept the rent increase proposed by the landlord. Therefore, the judgment under appeal, which rejected the request for a rent increase, is legally flawed. A judgment rejecting a rent increase - regardless of the amount - is contrary to the law, and the appellant should not be prejudiced by filing the appeal, especially since the respondent accepted the judgment issued by the court of first instance.
